Playing the Friendly Game with our Intellectual Property
How Parelli™ Enthusiasts May Refer to our Products and Training Methods on the Internet
Dear Consumer, Customer, Surfer – or even Competitor:
PARELLI NATURAL HORSEMANSHIP, INC. has become aware that many PARELLI™ enthusiasts around the world are using the Internet to share information and ideas about our special brand of natural horsemanship instruction. Several unofficial homepages have been established and there appears to be a great deal of activity and interest in these sites. Unfortunately, some of these sites use the PARELLI™ mark, horse head logo and/or our other trademarks in a manner which may lead to confusion about whether these sites are sponsored or authorized by PARELLI NATURAL HORSEMANSHIP, INC.
Therefore, we have developed these guidelines to assist Internet users who wish to refer to our training methods and products with the appropriate use of our trademarks for non-commercial purposes. However, you should be aware that it is impossible to set hard and fast rules about the proper use of our trademarks. This is because our objective is to prevent a use which, when viewed in the overall context, is likely to lead to a blurring or loss of distinctiveness of our trademarks or cause consumers to believe mistakenly that there is an affiliation with or sponsorship by PARELLI NATURAL HORSEMANSHIP, INC. Since use in different contexts may produce different impressions (or misimpressions) on the viewer, generalizations do not always apply to a particular case. Nevertheless, we offer these guidelines and ask for your help in order to keep our trademarks strong and distinctive.
What is a Trademark?
A trademark is a word, symbol or slogan that distinguishes the goods or services of one company from those of another company. A list of Trademarks owned by PARELLI NATURAL HORSEMANSHIP, INC. appears below. PARELLI NATURAL HORSEMANSHIP, INC. has acquired rights in all of these marks and has a policy of preventing their wrongful use by aggressively pursuing infringers.
A Trademark must be Protected
A trademark must be able to distinguish the goods of one company from those of another. If a trademark loses this ability, the owner may find that it can no longer prevent others from using the trademark. An owner must prevent the improper use of its trademarks to prevent the public from being deceived. This is why PARELLI NATURAL HORSEMANSHIP, INC. is very active around the world in making sure that its trademarks are not misused.
The Parelli name, logos and slogans may not be used on an Unofficial Web Site
The name PARELLI™ and the horse head logo have become some of the most recognized trademarks in the world among horse enthusiasts. We have worked hard to make our name and this logo, as well as our many other trademarks, symbols of our special and unique products and methods of teaching Natural Horsemanship. These logos stand for PARELLI NATURAL HORSEMANSHIP, INC. and we cannot risk allowing the distinctiveness of these symbols to be diluted. We must, therefore, insist that the PARELLI™ name and our other trademarks NEVER be used on an unofficial web site except as set forth below.
The Parelli Trademarks may be used under certain Limited Circumstances on an Unofficial Web Site
The PARELLI™ trademark (but not the logo) may be used in a non-commercial manner to refer to our products or training methods which are shown or discussed on a web site, as long as the trademark is not unduly emphasized or used in a way that can lead an observer to mistakenly believe that the site is sponsored or authorized by PARELLI NATURAL HORSEMANSHIP, INC. Whenever your site refers to our products or training methods we prefer (but do not require) that you include a link to our site: www.parellinaturalhorsetraining.com.
Proper Use of PARELLI™ Trademarks on a Web Site
If a PARELLI NATURAL HORSEMANSHIP, INC. trademark is used at all, it should always appear in the same typeface as the surrounding text and should not be isolated or set apart from the surrounding text. In other words, the trademarks should not be emphasized or highlighted. Finally, our trademarks should always appear with a ™ symbol each time they are used (i.e., Parelli™ or Parelli Natural Horsemanship™).
The Parelli Trademark cannot be used in an Internet Address
The PARELLI NATURAL HORSEMANSHIP, INC. trademarks should not be incorporated into an Internet address. Internet addresses have become useful tools for people to identify the source of a homepage. Using “PARELLI” in the domain name would be creating the misleading impression that PARELLI NATURAL HORSEMANSHIP, INC. sponsored the homepage.
Use a Disclaimer
A disclaimer should be used when any of our trademarks appear on a Web page. An appropriate disclaimer would be “Parelli Natural Horsemanship™ is a trademark of PARELLI NATURAL HORSEMANSHIP, INC. which does not sponsor, authorize or endorse this site”. However, a disclaimer will not serve to undo an improper trademark use. Therefore, use of the logo or improper use of other PARELLI NATURAL HORSEMANSHIP, INC. trademarks cannot be made proper by including a disclaimer.
See the list of trademarks owned by PARELLI NATURAL HORSEMANSHIP, INC. below and whether they may be used in accordance with these guidelines. Our list of trademarks is growing because our organization is always growing. Accordingly, the list below may not be up to date. If you are not sure whether a word, logo or slogan is one of our trademarks, please feel free to email us and ask.
What is a Copyright?
A copyright is a legal protection provided by the law of the United States (and other countries) designed to punish those who reproduce (i.e., copy in whole or in part), perform (i.e., put on a public demonstration of the Parelli Seven Games, for instance), display (like on a web site), or otherwise disseminate original works of authorship without the permission of the copyright owner. Copyright laws protect all of our web site content, DVD’s, streaming videos, photographs, books, and other written instructional materials.
Scanning Of Copyrighted Materials Into A Web Site
PARELLI NATURAL HORSEMANSHIP, INC. owns the copyrights to our web site content, DVD’s, streaming videos, photographs, books, and other written instructional materials. Copying, scanning and distributing these materials on the Internet would be an infringement of our copyrights. Nevertheless, at the present time PARELLI NATURAL HORSEMANSHIP, INC. does not object to scanning of limited extracts of these materials in unaltered form for non-commercial purposes of exchange of information or good faith commentary. However, scanned images/info should not be given such prominence as to indicate sponsorship of the Web site by PARELLI NATURAL HORSEMANSHIP, INC. We would ask that the photographs be scanned without distortion or overemphasis of the logo. A disclaimer and notice must appear indicating that the copyrights are owned by PARELLI NATURAL HORSEMANSHIP, INC. (Example: after a block of Parelli text or a Parelli image, prominently include the following: © PARELLI NATURAL HORSEMANSHIP, INC. This is an independent site not authorized or sponsored by PARELLI NATURAL HORSEMANSHIP, INC.).
We hope that these guidelines will address the most frequently asked questions about using the PARELLI™ line of trademarks and copyrights. We know that most users of the Internet want to respect these rights, but are not always certain about what is permissible. The Internet provides a great opportunity for instantaneous worldwide communication of ideas. Because the laws that govern the Internet are evolving, we may find it necessary to revise these guidelines from time to time. We appreciate the interest which has been expressed in our methods and philosophies and hope that this continuing dialog will help spread the message about Parelli Natural Horsemanship™ while simultaneously protecting what Pat and Linda have worked so hard to develop.
Thank you for your enthusiasm, understanding and cooperation.
